The Governor of Paraná, Beto Richa (PSDB), suffered the first judicial conviction for the massacre that occurred on April 29th of last year; the 15th Special Court of the Public Treasury of Curitiba ruled in favor of Professor Arnaldo dos Santos, who, along with the Legal Affairs Department of the APP-Sindicato (teachers' union), filed a lawsuit against the State for the physical and moral aggressions; this is the first successful lawsuit filed by the APP, which seeks compensation for teachers and school staff who were victims of the violence that occurred that day; more than 200 were injured.

The state government will have to pay compensation for the massacre of April 29th.
On July 11th, the 15th Special Court of the Public Treasury of Curitiba ruled in favor of Professor Arnaldo dos Santos, who, together with the Legal Affairs Department of the APP-Sindicato (teachers' union), filed a lawsuit against the State of Paraná due to the physical and moral assaults he suffered on April 29, 2015.
This is the first successful lawsuit filed by APP against the State seeking compensation for teachers and school staff who were victims of the brutality that occurred that day, abusive and disproportionate acts committed by the Military Police at the behest of the Secretary of Security, Fernando Francischini.
Professor Arnaldo, like many educators, filed a police report that day and needed to be treated at the Cajuru University Hospital, requiring him to take five days off work for medical treatment, highlighting the seriousness of the assault he suffered.
The State also attempted to claim that the officers were acting within the law, obeying superior orders, and even blamed the educators for remaining in their place, even aware of the possibility of police force being used, thus assuming the risk of injury. The fact is that the Federal Constitution and ILO Convention 87 provide for the protection of freedom of association, and it is the right of civilians and public servants to express their ideologies and rights. Furthermore, the Public Prosecutor's Office of Paraná (MP-PR) itself filed a public action against Governor Beto Richa (PSDB) for acts of administrative misconduct, identifying him as one of those responsible for the police operation carried out in the Civic Center.
The educators were occupying the public space of Nossa Senhora da Salete Square with the intention of demonstrating their disapproval of Bill 252, thus having the absolute right to express their opinion and ideals. It was also proven that disproportionate and unreasonable physical force was used when compared to the unarmed teachers and school staff, who posed no danger to the officers and had no intention of occupying the Paraná Legislative Assembly building.
Thus, Judge Letícia de Paula Eduardo Bonatto argued that the defendant, the State of Paraná, should be held responsible for the conduct of its agents, punishing it for the suppression of the fundamental rights of citizens and for the arbitrary use of violence, as well as discouraging it from committing new illegal and violent acts when faced with demonstrations. Professor Arnaldo will receive monetary compensation from the State for material and moral damages.
According to the Secretary of Legal Affairs of APP, Professor Mário Sérgio Ferreira, the issue of seeking compensation goes far beyond the amount each teacher will receive. “This conviction is to show the State that it cannot act with such violence when the population demonstrates. It is indeed necessary to protect public property, but it must also protect the citizen, the citizen who has the right to demonstrate,” he explains.
