The Federal Public Prosecutor's Office of Paraná files a request to annul Tacla Duran's testimony.
Lawyer denounced extortion of US$ 5 million suffered by Lava Jato and prosecutors.
From Conjur – The Federal Public Prosecutor's Office of Paraná has filed a request to annul the testimony in which lawyer Rodrigo Tacla Duran accused former judge and current senator Sergio Moro (União Brasil) and former prosecutor and current federal deputy Deltan Dallagnol (Podemos) of asking for money to prevent his arrest at the height of the now-defunct "Lava Jato" operation.
The request from the Federal Public Prosecutor's Office was signed by the Federal Prosecutor Walter José Mathias Júnior, who accompanied the testimony given last Monday (March 27) to Judge Eduardo Appio, of the 13th Federal Court of Curitiba.
In the text, the prosecutor argues that Appio was negligent, since at the end of the deposition the Federal Public Prosecutor's Office expressly requested confidentiality of the proceedings, given that facts concerning parliamentarians with parliamentary immunity were being presented.
The prosecutor also argues that, with the decision by Minister Ricardo Lewandowski of the Supreme Federal Court to suspend criminal proceedings against Tacla Duran, the testimony would become null and void.
The Federal Public Prosecutor's Office of Paraná (MPF-PR) argues that the testimony would serve to adjust the precautionary measures that would replace the preventive detention against Tacla Duran, which had been revoked.
"However, when the defendant, who is representing himself, was given the floor, the ceremony served as an opportunity—in the name of the right to a full defense—to criticize the work carried out by the Task Force and Magistrates who preceded the proceedings before this Court, and to speculate on alleged evidence that he has supposedly had for years, arguing that there is no urgency to lift the suspension."
The Federal Public Prosecutor's Office of Paraná is requesting explanations regarding the questions raised by the lawyer and that the judge of the 13th Federal Court of Curitiba reconsider the request for confidentiality.

In turn, Tacla Duran requested that Lewandowski's decision to suspend the criminal proceedings against him be extended to the petition in which former judge Sergio Moro suggested that Judge Eduardo Appio should not issue new rulings on this and other "Lava Jato" cases before a recusal request filed by the Federal Public Prosecutor's Office is decided.
If Appio rejects the objection of bias, Moro requests that such a request be forwarded to the Federal Regional Court of the 4th Region, whose 8th Panel has a history of rulings favorable to him.
"Such an intervention, bizarre, it must be said, is the result of this citizen's lack of limits, in pursuit of his personal interests and desires, who used and abused the seat of this esteemed court as a political platform, and now, faced with an imminent investigation by the competent forum, since he is a Senator of the Republic, he attempts to circumvent the jurisdiction of the Supreme Court," stated Tacla Duran.
