Minister Cristiano Zanin will judge Sergio Moro at the Supreme Court.

The rapporteur for the case involving the suspected former judge, Minister Cármen Lúcia, scheduled the start of the trial in a virtual session.

247 - The First Panel of the Supreme Federal Court will judge, starting on October 3, the motions for clarification presented by Senator Sergio Moro (União Brasil-PR) in a criminal action for defamation against Minister Gilmar Mendes. The rapporteur of the case involving the former judge under suspicion, Minister Cármen Lúcia, scheduled the start of the trial in a virtual session, according to information published this Thursday (24) by column by Paulo Cappelli.

Minister Cristiano Zanin is the current president of the First Chamber of the Supreme Federal Court (STF). Before the start of the trial, he will hand over the presidency of the First Chamber to Minister Flávio Dino.

According to the complaint filed by the Attorney General's Office (PGR), Moro falsely accused Gilmar Mendes of the crime of passive corruption, insinuating that the minister "sells habeas corpus."

During an event in June 2022, Moro said: "No, that's bail, an institution... to buy a habeas corpus from Gilmar Mendes," suggesting that court decisions could be negotiated in exchange for undue advantages.

In his defense, Moro stated that the comment was made jokingly during a June festival. The senator also claimed that he publicly apologized, which, according to him, should extinguish any criminal liability.

Former Lava Jato prosecutor Moro was declared biased in 2021 by the Supreme Federal Court, which restored the political rights of then-President Lula. The following year, the former judge was also defeated in the Regional Electoral Court (TRE-SP) for electoral domicile fraud.
