Walter Delgatti speaks of 'risk' in prison; Moraes is contacted.
The decision fulfills a request from the Attorney General's Office (PGR).
247 - Brazilian Supreme Court Justice Alexandre de Moraes has ordered the São Paulo State Penitentiary Administration (SAP-SP) to report whether Walter Delgatti Neto, known as the Araraquara hacker, is at risk within the prison system. The decision responds to a request from the Attorney General's Office (PGR) and was reported by the news portal. UOL
The department has ten days to provide clarifications and assess the feasibility of transferring Delgatti to the Dr. José Augusto César Salgado Penitentiary in Tremembé, a unit that houses high-profile inmates.
Defense alleges threats inside prison.
On January 8th, Delgatti's lawyers submitted a request to the Supreme Federal Court (STF) warning of the hacker's life-threatening situation in prison. According to the defense, the political polarization in the country makes him an "easy target." "The political polarization we are currently facing, rooted in all sectors of social life, even family units, makes the 'Hacker of Araraquara,' as he became known, an easy target within the prison, having received serious and frequent threats during his incarceration in the city of Araraquara," the lawyers stated.
Attorney General's Office requests conviction of Delgatti and Carla Zambelli
Last Saturday (1st), the Attorney General's Office requested the conviction of Walter Delgatti Neto and federal deputy Carla Zambelli (PL-SP) for allegedly invading the systems of the National Council of Justice (CNJ). According to the Attorney General's Office, Zambelli allegedly used the hacker's services to "create an environment of demoralization of the Brazilian Justice system" between the end of 2022 and the beginning of 2023, shortly after Jair Bolsonaro's (PL) defeat in the presidential elections.
The Attorney General's Office (PGR) is requesting the conviction of both individuals for unauthorized access to a computer system and falsification of documents, with the aggravating circumstance of increased penalties. "The Attorney General's Office requests the conviction of Carla Zambelli Salgado de Oliveira and Walter Delgatti Neto for the criminal offenses of unauthorized access to a computer system and falsification of documents, with the application of the aggravating circumstance of increased penalties," stated the PGR in an official statement.
Investigations indicate that Delgatti carried out ten intrusions into judicial systems, including the creation of false arrest warrants, asset freezes, and breaches of confidentiality against Minister Alexandre de Moraes himself. Furthermore, the hacker allegedly produced false release orders for prisoners, including a leader of the Comando Vermelho gang sentenced to more than 200 years in prison.
Zambelli's defense denies involvement.
In a statement released last year, Carla Zambelli's defense denied any involvement in the crimes and stated that the investigation did not gather enough evidence to prove her guilt. The case is still ongoing at the Supreme Federal Court (STF).
