Court rejects request to arrest Elize Matsunaga for using a false document.
The court ruled that Elize “has complied with the conditions imposed on her” to maintain the benefit of parole.
247 - The Criminal Enforcement Court of Franca, in the interior of São Paulo, ruled that Elize Matsunaga (now Elize Giacomini) will remain on probation, denying an arrest warrant issued by the São Paulo Public Prosecutor's Office requesting that she be imprisoned for using false documentation.
The court considered that Elize “has complied with the conditions imposed on her” to maintain the benefit of parole. It added that the case of using a false document, discovered in Sorocaba, also in the interior of São Paulo state, is still in progress and “in its initial phase.”
Elize was sentenced to 16 years in prison after killing her husband, businessman Marcos Kitano Matsunaga, in 2012. Last May, she was granted parole by the court. Currently, she works as a rideshare driver.
Last week, she was indicted by the Civil Police of Sorocaba after using a false document to obtain employment at a company that required a certificate of no criminal record. According to the SSP (Public Security Secretariat), an expert analysis confirmed the irregularity.
The decision to release Elize was made by the State Department of Criminal Enforcement of the 9th Judicial Administrative Region. She was imprisoned in Tremembé, in the Paraíba Valley.
