Brazilian court orders Apple to pay R$100 million in damages and compels company to sell cell phones with chargers.
The Judiciary has granted a public civil action filed by the Brazilian Association of Borrowers, Consumers and Taxpayers (ABMCC).
247 - Judge Caramuru Afonso Francisco, of the 18th Civil Court of the Court of Justice of São Paulo, condemned Apple to pay R$ 100 million and forced the company to sell cell phones with chargers. Apple says it will appeal the decision. The magistrate granted a public civil action by the Brazilian Association of Mortgagees, Consumers and Taxpayers (ABMCC). The information was published this Thursday (13) by G1 portal.
"I also condemn the defendant to the obligation to act, namely, that, from the date the judgment becomes final, it only sells its telephone devices, in all models marketed by it in the national territory, provided that it supplies the respective power adapters to its new customers," the document stated.
"Finally, I condemn the defendant to pay the fixed sum, as compensation for social damages, in the amount of R$ 100 million, in values from the date of filing the lawsuit, with interest for late payment of 1% per month, compounded annually," he added.
In a statement, Apple said the move was taken to reduce carbon emissions. "At Apple, we consider our impact on people and the planet in everything we do. Power adapters accounted for our largest use of zinc and plastic, and removing them from the box has helped reduce more than 2 million metric tons of carbon emissions—the equivalent of taking 500.000 cars off the road per year," it said.
"There are billions of USB-A power adapters already in use worldwide that our customers can use to charge and connect their devices. We have already won several court decisions in Brazil on this matter and we are confident that our customers are aware of the various options for charging and connecting their devices," he added.
