247 - The National Justice Inspector, Minister Nancy Andrighi, decided this Thursday (26) to immediately remove from office Judge Flávio Roberto de Souza, of the 3rd Federal Court of Rio de Janeiro. Responsible for criminal actions against Eike Batista, Souza was caught this week driving a Porsche Cayenne seized from the businessman. He also gave neighbors custody of another car belonging to Eike's family, a Range Rover, and a grand piano.

According to Andrighi's decision, all proceedings concerning Eike Batista will have to be removed from Souza's jurisdiction and randomly redistributed to other Federal Criminal Courts. The minister argued that by using the defendant's assets, Souza confused his role as a magistrate with that of a private individual, causing national repercussions.

The length of the judge's suspension will be determined by the full CNJ (National Council of Justice), the body that houses the Inspector General's Office. Souza may appeal the decision, perhaps with a writ of mandamus before the Supreme Federal Court. The decision also considers that the judge behaved improperly by expressing himself negatively about Eike in several interviews.
