Green Party deputy accused of falsifying documents.
Magno Bacelar was indicted by the Public Prosecutor's Office for the crime of falsifying documents; according to the Prosecutor's Office, when he was mayor of Chapadinha, he inserted a false statement into a public document in a state of emergency decree; the Court of Justice accepted the indictment to initiate criminal proceedings.
Court of Justice of Maranhão - The Court of Justice of Maranhão (TJMA) received this Wednesday (12) a complaint from the Public Prosecutor's Office against state deputy Magno Bacelar. The accusation is that the parliamentarian, when he held the position of mayor of the municipality of Chapadinha, would have committed the crime of ideological falsehood, by including information considered false in a state of emergency decree.
By unanimous vote, the Special Panel of the TJMA (Court of Justice of Maranhão) accepted the complaint, in accordance with the opinion of the rapporteur, Judge Kleber Carvalho, and the opinion of the Attorney General's Office (PGJ), so that the criminal action against Bacelar may proceed.
In the case file, the Public Prosecutor's Office alleges that, on April 4, 2008, the then-mayor of Chapadinha inserted a false statement into a public document, different from what actually occurred, with the aim of altering the truth about a legally relevant fact.
According to the ministerial body, the former mayor allegedly included false statements in the decree, describing incalculable losses and damages – such as destroyed roads, ditches and canals, as well as damage to bridges and crops, among other alleged problems.
Magno Bacelar maintained that he had no intention of receiving federal funds or bypassing the bidding process, and that he did not, in fact, act in this way. He stated that he revoked the administrative act and that the accusation is generic.
The rapporteur noted that the complaint specified the alleged criminal act and indicated the legal classification of the conduct. He added that the conduct, theoretically considered criminal, would consist of including knowingly false information in a decree, thus constituting the crime under Article 299 of the Penal Code.
Kleber Carvalho highlighted that the complaint was accompanied by sufficient minimum evidence to support its acceptance, notwithstanding the right to a full defense and due process. He verified the existence of elements that support a reasonable suspicion of the commission of the crime. The rapporteur accepted the complaint for the initiation of criminal proceedings, a vote supported by the other members present.
