Toffoli suspends Federal Police operation in Serra's Senate office due to lack of authorization from the Supreme Court.

The president of the Supreme Federal Court (STF), Minister Dias Toffoli, suspended the search and seizure warrant issued by the São Paulo Judiciary, within the scope of Lava Jato, in the office of José Serra (PSDB-SP). Serra is accused of having received millions of dollars in illegal funds during his Senate campaign.

247 - The president of the Supreme Federal Court (STF), Minister Dias Toffoli, suspended this Tuesday (21) the judicial order for search and seizure issued by the 1st Electoral Zone of São Paulo in the office of Senator José Serra (PSDB-SP), suspected of having received R$ 5 million in unaccounted donations in his 2014 campaign. 

"Based on this understanding and considering, in this summary judgment, that the decision of the challenged authority may lead to the seizure of documents related to the performance of the parliamentary activity of the Senator of the Republic, which are not related to the object of the investigation, without prejudice to re-analysis by the eminent Rapporteur, I grant the preliminary injunction to suspend the judicial order for search and seizure issued on July 21, 2020, by Judge Marcelo Antonio Martin Vargas, of the 1st Electoral Zone of São Paulo, on the premises of the Federal Senate, more specifically in the office of Senator José Serra. Communicate this urgently, requesting information from the challenged authority. Afterwards, the case file should be sent to the Attorney General's Office. This decision serves as a warrant," said Toffoli, according to the... CNN Brazil.

The president of the Senate, Davi Alcolumbre (DEM-AP), prevented the execution of a search and seizure warrant in the parliamentarian's office on Tuesday morning (21). In a complaint to the Supreme Court, the Senate stated that Search and seizure warrants in offices must originate from the court itself..

The court order was issued as part of the Lava Jato Operation investigations.
