Superior Court of Justice denies request for arrest warrant against Agnelo Queiroz.
The request had been made by district deputy Celina Leo (PSD) on April 18; the special court's decision was unanimous.
Brasilia 247 – On the afternoon of Wednesday, May 2nd, the Special Court of the Superior Court of Justice (STJ) unanimously rejected a request for preventive detention against the governor of the Federal District, Agnelo Queiroz. The request had been submitted by district deputy Celina Leão (PSD) on April 18th.
Minister Cesar Asfor Rocha, rapporteur of the inquiry investigating fraud at the Ministry of Sports, where Agnelo Queiroz was head, accepted the opinion of the Attorney General of the Republic, Roberto Gurgel, concluding that there is no need for imprisonment at this stage of the proceedings. According to the minister, although there is already evidence of materiality in the investigated case, the authorship of the acts still depends on further investigation.
However, ministers Gilson Dipp, Arnaldo Esteves Lima, and Maria Thereza de Assis Moura, who also rejected the arrest, used a different argument. They reasoned that the congresswoman lacked the legal standing to file such a request.
Celina's request was based on press reports which, according to the court, were not sufficient to justify her arrest. The reports stated that the government of the Federal District was wiretapping politicians and journalists.
