Sale of 224 Terracap plots of land prohibited.

The Public Prosecutor's Office wants to prevent land subdivisions in the satellite cities of Águas Claras, Samambaia, and Noroeste; technical studies on the impacts on the road network were requested at the end of 2011 and have not yet been presented; the vehicle fleet in the Federal District is the second fastest growing in the country.

Brasília 247 - The Public Prosecutor's Office of the Federal District and Territories (MPDFT) filed a Public Civil Action with a request for an injunction against the Brasília Real Estate Company (Terracap). The MPDFT's objective is to prohibit the sale of properties in Águas Claras, Samambaia, and Noroeste until studies on the road capacity of these regions are presented.

Prosecutors believe that Terracap failed to consider the impact on the road and highway system of the Federal District when it promoted the subdivision of land in these locations.

In the lawsuit, the MPDFT (Public Prosecutor's Office of the Federal District) argues that it is necessary to conduct preliminary studies to prove whether or not the region's roads can absorb the demands resulting from the implementation of new and existing projects.

It was determined that, at the end of 2011, the Department of Transit (Detran-DF) recommended that Terracap prepare a road capacity study (ECV) of the three administrative regions to assess the repercussions of projects under implementation and already implemented on traffic and the capacity of the road network, among other things.

The lawsuit emphasizes that the fleet of private vehicles in the Federal District is the second fastest growing in the country, while the quality of public transportation service is poor and among the most expensive in Brazil.

Despite not having completed these studies, Terracap made available for sale 200 real estate units in Samambaia, 21 in Noroeste, and three in Águas Claras.

According to the lawsuit, the Company's behavior jeopardizes the quality of life of the inhabitants of these locations, since the current road and public transport infrastructure network, even without this increased demand, is already insufficient. In the lawsuit, the MPDFT (Public Prosecutor's Office of the Federal District) requests that the lots not be auctioned until a technical study is completed certifying that the road system can accommodate the developments to be implemented by the future buyers of the lots auctioned by Terracap.
