Da Current Brazil Network - On the same day that he denied an appeal by the defense of former president Luiz Inácio Lula da Silva that canceled a trial that could have freed him, Supreme Federal Court (STF) Justice Edson Fachin dismissed a Federal Police (PF) investigation against coup-installed president Michel Temer. The investigation concerned a handwritten document seized in the office of Senator Ciro Nogueira (PP) from Piauí, mentioning "Fund 1.000 Imp 200 RT 200 2 Temer 300 300".

The operation targeted Nogueira, accused of buying the silence of a witness and obstructing justice. On April 24 of this year, the Federal Police had launched a series of search and seizure operations in the National Congress, seizing documents in the offices of Ciro and Eduardo da Fonte (PE), also a federal deputy from the PP party.

Ciro Nogueira and Fonte are alleged to be acting in a criminal association along with other PP parliamentarians: Aguinaldo Ribeiro, Arthur Lira, Benedito de Lira, José Otávio Germano, Luiz Fernando Faria, and Nelson Meurer. The investigation is part of a complaint filed by the Federal Public Prosecutor's Office (MPF) in September of last year.

The PP politicians were allegedly part of a criminal organization that committed crimes within the Chamber of Deputies, collecting bribes through the use of various public bodies of the direct and indirect public administration, according to the indictment. During the investigations, suspicions arose that the parliamentarians were attempting to destroy evidence or obstruct the investigations.

However, among the many documents seized, one could directly implicate the current president, Michel Temer. It is linked to numbers in a file. The characters "fundo 1.000, Imp 200, RT 200 2" appear next to "Temer 300 300".

The Federal Police did not identify the meaning of these numbers, nor did they wish to prolong the investigation. Therefore, the request for dismissal was made by the Attorney General of the Republic, Raquel Dodge. In response, Minister Edson Fachin, rapporteur of Operation Lava Jato at the Supreme Court, accepted the request.

"Except in cases where the Attorney General requests the dismissal of an investigation based on the atypical nature of the conduct or the extinction of punishability, it is the settled jurisprudence of this Court that granting the request is mandatory, regardless of the analysis of the reasons invoked," the minister stated in his ruling.

Fachin also stated that the investigation could be reopened if new evidence against Temer emerges. "I emphasize, however, that the dismissal granted based on the lack of sufficient evidence does not prevent the continuation of investigations should new evidence emerge in the future."
