Lindbergh rejects Zambelli's plan to evade justice using the Magnitsky Law and warns she could lose her mandate.

A right-wing extremist, imprisoned in Italy, is orchestrating, through her defense lawyers, a maneuver to prevent her extradition.

247 - Federal deputy Lindbergh Farias (PT-RJ), leader of the party's caucus in the Chamber, went to social media this Monday (4) to reject the plan of the imprisoned deputy Carla Zambelli (PL-SP). She is trying to escape justice after having fled and been arrested in Italy.

Convicted of hacking into the national justice system, the far-right extremist is orchestrating, through her defense lawyers, a maneuver to prevent her extradition, arguing to the Italian courts that her conviction in Brazil was determined by a judge covered by the Magnitsky Act, in this case, Alexandre de Moraes, a minister of the Supreme Federal Court (STF). 

According to Lindbergh, the attempt is doomed to failure. In a post on the X platform, he stated that Zambelli grotesquely distorts reality and should not escape the legal proceedings she faces in Brazil. 

Convicted congresswoman Carla Zambelli is now attempting to evade Brazilian justice by invoking the "Magnitsky Act" in Italy. According to members of the PL party interviewed by the press, Zambelli's strategy is to claim to the Italian courts that she was convicted by a judge who was allegedly "framed" under the Magnitsky Act, in an attempt to portray political persecution and avoid extradition, serving her sentence in Italy. This is a grotesque inversion of reality: someone who circumvented the law, fled the country, and forged judicial decisions wants to portray herself as a victim to maintain her mandate and impunity.

Ministers Barroso, Mendes, Moraes, and Fachin reacted firmly: using the Magnitsky Act against a Supreme Court justice is undue interference and a threat to national sovereignty. The attempt to transform a convicted criminal into a political martyr, with the support of far-right foreign parliamentarians, is unacceptable and offensive to the Brazilian constitutional order.

Meanwhile, the Chamber's Constitution and Justice Committee is already discussing Zambelli's removal from office, with a vote expected in August. Our caucus has already submitted a petition requesting the immediate forwarding of the process to the Board of Directors to formalize the loss of her mandate, as mandated by the Constitution. Those who evade justice and attack the rule of law cannot continue legislating, neither in Brazil, nor remotely, nor by proxy.

Because she holds dual citizenship, Zambelli left Brazil in May of this year to seek political asylum in Italy after being sentenced by the Supreme Federal Court (STF) to 10 years in prison for hacking into the electronic system of the National Council of Justice (CNJ), which occurred in 2023. The congresswoman will also have to pay R$ 2 million in collective damages.

According to investigations, Zambelli was the mastermind behind the hack to issue a false arrest warrant for Alexandre de Moraes. According to investigations, the hacking was carried out by Walter Delgatti, who was also convicted and confirmed that he carried out the work at the parliamentarian's behest.

After fleeing to Italy, the Brazilian government requested the extradition of the congresswoman to Brazil. The extradition request for Carla Zambelli was formalized on June 11th by Minister Alexandre de Moraes. Subsequently, the request was sent by the Brazilian Ministry of Foreign Affairs (Itamaraty) to the Italian government.

The Attorney General's Office (AGU) confirmed that it will take all necessary measures to conclude the extradition process. (With information from Agência Brasil).
