Lewandowski: Changes to the secret budget approved by Congress address the Supreme Court's concerns.

247 - Supreme Federal Court (STF) minister Ricardo Lewandowski stated this Friday (16) that the changes approved by the National Congress in the execution of the so-called budget meet concerns expressed by ministers of the Court. 

"We paused [the trial] in deference to Congress. Now, we have a resolution and we will certainly take that resolution into consideration in the trial," stated Minister Lewandowski. "Much of what was proposed by the resolution addressed concerns raised by the ministers during the trial," added the minister, who, like Gilmar Mendes, did not vote on the matter. 

The National Congress approved this Friday (16) a Draft resolution defining criteria for the distribution of the general rapporteur's amendments to the Budget., better known as the secret budget.

According to the Senate, the resolution presented by the Senate and Chamber of Deputies leadership establishes criteria to provide transparency to the general rapporteur's budget amendments. The bill excludes the "external user" category, used by municipalities to request amendments (and which conceals the name of the parliamentarian who sponsored the allocation).

According to the proposal approved in a joint session of Congress, 80% of the resources will go to party allocations based on the size of their representation in Congress (with one-third of the total going to Senate allocations and the remainder to Chamber of Deputies allocations). The PL and PT parties are the biggest beneficiaries.

The Supreme Court suspended the secret budget trial on Thursday (15). Five ministers voted against and four gave votes in favor of the scheme. Rapporteur of the matter in the STF, Minister Rosa Weber gave a vote against the secret budget. Ministers Edson Fachin, Luís Roberto Barroso, Luiz Fux and Cármen Lúcia followed her vote.

Ministers Alexandre de Moraes, Dias Toffoli, André Mendonça, and Nunes Marques voted against the scheme. The votes of Lewandowski and Gilmar Mendes are still pending.
