Court suspends presentation of PPCUB.

The 3rd public hearing to present the draft bill for the Preservation Plan of the Urban Complex of Brasília (PPCUB) was suspended by order of the Federal Court this morning (March 31). The event was scheduled to begin at 8 am in the auditorium of the National Museum of the Republic. Due to the ruling, the hearing had to be converted into a public debate. Approximately 600 people attended the event, which has no scheduled end time.

This would be the final public hearing of the PPCUB, necessary for the conclusion of a definitive law on land use and occupation in Brasília. The text should impose clear limits for green, commercial, and residential areas within the protected urban area of ​​the Federal District: Plano Piloto, Candangolândia, Cruzeiro, Sudoeste, and the Octagonal Areas.

On Monday (26) the Public Ministry of the Federal District had issued a recommendation for the Secretariat of Housing, Regularization and Urban Development (Sedhab) to hold another hearing regarding the PPCUB, in addition to the three already scheduled. The Public Prosecutor's Office for the Defense of Urban Order (Prourb) justified the request by stating that the population did not have access to the documents used in the preparation of the plan. According to the recommendation, the call for bids should have informed the physical location where the material would be available for public consultation.

Late yesterday afternoon (30), the Federal District Court of Auditors (TCDF) accepted the representation of the Public Ministry and ordered the Secretariat to suspend the hearing as a precautionary measure. The preliminary decision stated that the principles of publicity, transparency and democratic management of cities had not been observed.

At the request of the Federal District Government, the Attorney General's Office of the Federal District (PGDF) filed a writ of mandamus and managed to secure the hearing at 23 pm yesterday. However, at 6 am this Saturday, the 9th Federal Court of the Federal District issued an injunction that again suspended the event.

Sedhab claims that it convened the hearing 40 days in advance and published the list of attendees for three consecutive days in the Official Gazette of the Federal District (DODF). Sedhab also stated that it made all the material related to the debate available on its website. The public debate will present the ideas of the people who attended the event, as well as the results of meetings the department held with academics, representatives of the construction industry, and spokespeople for residents of the areas affected by the project.

The content of the debate should be used in the preparation of a new hearing. “On Monday we will analyze the entire legal battle that has ensued, because there has been a lot of distortion of information. What surprised us is that the people who requested the court decisions could have done so 30 or 40 days ago, and not harm the process,” complained the housing secretary, Geraldo Magela. The new summons should be published next week, and has a minimum deadline of 30 days until the date of the hearing.
