Janot analyzes Dias Toffoli's impartiality in the investigation.

Brazil's Attorney General, Rodrigo Janot, will analyze whether to request the removal of Supreme Court Justice Dias Toffoli from investigations related to Operation Custo Brasil, an offshoot of Lava Jato investigating irregularities in the granting of payroll loans to public servants. Documents regarding the case have been sent to Janot's office, which will decide whether to request the Supreme Court to declare the Justice ineligible to participate in the investigation.

247 - Rodrigo Janot, the Attorney General of the Republic, will analyze whether to request the removal of Supreme Court Justice Dias Toffoli from the investigations related to Operation Custo Brasil, an offshoot of Lava Jato investigating irregularities in the granting of payroll loans to civil servants. Documents about the case have been sent to Janot's office, which will decide whether to request the Supreme Court to declare the Justice ineligible due to bias. There is no deadline for the Attorney General to make a decision on the case.

Cell phone messages and emails seized by the Federal Police indicate that Toffoli has a close friendship with former Social Security Minister Carlos Gabas, one of the individuals under investigation, which could violate the "duties of impartiality" in the judiciary.

"Documents regarding the case, kept confidential, were sent last week by the Public Prosecutor's Office in São Paulo to Janot's office, which will decide whether to request the Supreme Court to recuse the minister. There is no deadline, however, for the Attorney General to make a decision on the case."

According to a source who had access to the investigation, the communications show that Toffoli and Gabas arranged meetings outside of work hours and planned social events, even a barbecue, which caught the attention of the Federal Public Prosecutor's Office.

The president of the Supreme Court, Cármen Lúcia, was also notified. Janot can request the case be dismissed or argue the minister's bias, which would lead to requesting explanations from Toffoli himself. If the minister believes there is no impediment and continues participating in the case's judgments, it will be up to the full Supreme Court to decide whether or not to remove him.
