In his decision, Mendes stated that the Anti-Crime Law provides for the re-evaluation of preventive detention every 90 days, during which the Public Prosecutor's Office must present concrete and current facts justifying the precautionary measure against the investigated party, which, according to the minister, did not occur. “Considering that the arrest warrant dates from January 2020, coinciding with the receipt of the indictment, the lack of contemporaneity of the facts used as grounds is explicit,” stated Mendes. “Therefore, I grant the order to revoke the arrest warrant and determine the immediate issuance of a release order in favor of the defendant, if he is not detained for another reason,” he added.
