Gilmar releases lawyer who was part of a group investigated for tax fraud amounting to R$ 500 million.

247 - Supreme Court Justice Gilmar Mendes revoked the preventive detention of lawyer Daniel Ângelo, a target of Operation Palhares, which investigated the activities of lawyers who forged millions of reais in tax credits and sold them for half the value so that companies could reduce their debts with the Federal Revenue Service. According to Rio police, the accused and the business entities that were 'established to launder money' moved approximately R$ 500 million.

In his decision, Mendes stated that the Anti-Crime Law provides for the re-evaluation of preventive detention every 90 days, during which the Public Prosecutor's Office must present concrete and current facts justifying the precautionary measure against the investigated party, which, according to the minister, did not occur. “Considering that the arrest warrant dates from January 2020, coinciding with the receipt of the indictment, the lack of contemporaneity of the facts used as grounds is explicit,” stated Mendes. “Therefore, I grant the order to revoke the arrest warrant and determine the immediate issuance of a release order in favor of the defendant, if he is not detained for another reason,” he added.
