Brazilian Attorney General's complaint against Bolsonaro: Barroso rejects request to disqualify Alexandre de Moraes, Flávio Dino, and Cristiano Zanin.

Braga Netto's defense also asked the Court to declare the disqualification of one of the ministers who will judge those accused by the Attorney General's Office in the coup investigation.

The president of the Supreme Federal Court (STF), Minister Luís Roberto Barroso, denied on Friday (28) requests for disqualification to declare Ministers Alexandre de Moraes, Flávio Dino and Cristiano Zanin disqualified from judging the complaint filed against former President Jair Bolsonaro involving the coup plot.

This week, Bolsonaro's defense filed a petition asking the Court to recognize the impossibility of Dino and Zanin participating in the trial, which still has no set date. Moraes's disqualification was requested by General Braga Netto's defense. 

The lawyers pointed out that Flávio Dino filed a criminal complaint against Bolsonaro when he held the position of Minister of Justice and Public Security in the first months of President Luiz Inácio Lula da Silva's government.

In Zanin's case, the former president's defense says that, before arriving at the Court, the minister was a lawyer for Lula's campaign and filed lawsuits against Bolsonaro's ticket in the 2022 elections.

First class

The impeachment proceedings were directed at the ministers because they are part of the Supreme Court's First Chamber, the body that will judge the charges against Bolsonaro.

The panel is composed of the rapporteur, Alexandre de Moraes, and ministers Flávio Dino, Cristiano Zanin, Cármen Lúcia, and Luiz Fux.

According to the Court's internal rules, the court's two panels are responsible for adjudicating criminal cases. Since the reporting judge is part of the First Panel, the charges will be heard by the panel.

If the majority of ministers accept the charges, Bolsonaro and the other defendants will become defendants and will face criminal proceedings before the Supreme Federal Court.

The trial date has not yet been set. Given the legal process, the case could be heard in the first half of 2025.
