Leading in opinion polls with 35% of voting intentions, according to the latest Datafolha survey, José Roberto Arruda (PR) is also the champion in incidents involving the courts and audit courts. The Transparência Brasil search system shows 26 incidents for the former governor of the Federal District, convicted in the second instance in the trial of the case known as the DEM mensalão.
Arruda has two convictions for administrative misconduct and is facing nine other lawsuits with the same classification. The politician also has three indictments for crimes under the Bidding Law, one of which is also for criminal association, is a defendant in a lawsuit for forming a criminal gang, and in two others for falsifying documents. He also appears as a defendant for active corruption in two cases in the 7th Criminal Court of Brasília and in seven cases for passive corruption in the same court.
The PR politician is one of four gubernatorial candidates in the country who previously held the position and were impeached. He lost his mandate due to party disloyalty, in a spin-off of the DEM's mensalão scandal. Cassio Cunha Lima (PSDB), who is trying to return to lead the government of Paraíba, was impeached while in office in 2009. He was accused of buying votes by distributing checks to the population as part of an alleged assistance program. Mão Santa (PSC), a candidate in Piauí, was impeached in 2001, accused of abuse of economic power. Marcelo Miranda (PMDB), a candidate in Tocantins, lost his governorship in 2009 for vote buying and abuse of economic power.
With his candidacy registration denied by the Regional Electoral Court (TRE-DF), Arruda awaits a decision on his appeal to the Superior Electoral Court (TSE). A favorite among voters in the Federal District since the first polls and possessing significant communication skills, Arruda's main challenge is resolving the legal issues to reach the Buriti Palace (the governor's residence).
In second place in the polls, with 17% of voting intentions, the current governor of the Federal District and candidate for re-election, Agnelo Queiroz (PT), has a public civil action against him filed by the Public Prosecutor's Office with the Court of Justice (TJDFT).
In third place, with 13%, Rodrigo Rollemberg (PSB) is under investigation by the Federal Court of Accounts (TCU) in a process related to the 2006 audit of the executive secretariat of the Ministry of Science and Technology and its units. At the time, the senator was identified as responsible in the process, since he was the Secretary of Social Inclusion of the ministry.
Toninho do Psol (PSOL) has two incidents identified by the Transparência Brasil system, both at the Federal District Court of Accounts (TCDF). In both situations, he was fined, one for irregularities related to purchase orders when he was Secretary of Administration of Brasília, and another for appointing police officers after the expiration date of the competitive examination in which they were approved, also related to the time when he was Secretary of Administration of Brasília.
Perci Marrara (PCO) has a complaint filed against her at the Regional Electoral Court (TRE-DF) regarding the accounting of her campaign for federal deputy in 2010. Luiz (Pitiman) has no complaints filed against him.
