247 - Senator Alessandro Vieira (MDB-SE) will be the rapporteur for the Constitutional Amendment Proposal (PEC) on Prerogatives (3/2021) in the Senate's Constitution and Justice Committee (CCJ). Known as the "Shielding PEC," this Constitutional Amendment Proposal reinstates the requirement for authorization from the Chamber of Deputies and the Senate for the Supreme Federal Court (STF) to criminally prosecute deputies and senators.
“I received from the president of the CCJ @ottoalencar the mission of reporting on the so-called Shielding PEC in the Senate. My position on the subject is public and the report will be for rejection, technically demonstrating the enormous harm that this proposal can cause to Brazilians,” Vieira stated on the social network X.
Another controversial point of the proposal is the secret ballot, rather than an open one, to decide on any member of parliament.
The proposed constitutional amendment reinstates the requirement for authorization from both the Senate and the Chamber of Deputies for the Supreme Federal Court (STF) to criminally prosecute members of Congress. The vote will be secret, according to the text approved by the federal deputies. There were 344 votes in favor and 133 against the bill, which will now be sent to the Senate.
The bill also stipulates that party presidents will only be tried by the Supreme Federal Court (STF), and not by lower courts. According to the Constitution, only the STF can try the President and Vice-President of the Republic, Ministers of State, the Attorney General of the Republic, and members of the National Congress.
