At Barbosa's request, the Federal Police are investigating Genoino's lawyer.

In the complaint he sent to the Public Prosecutor's Office, Minister Joaquim Barbosa accuses lawyer Luiz Fernando Pacheco of contempt, slander, defamation, and libel; in a session on June 11, the lawyer was expelled from the Supreme Court session by order of Barbosa, because the defense attorney insisted that the request for house arrest for José Genoino be analyzed by the full court.

247 - The Federal Police have opened an investigation into the conduct of lawyer Luiz Fernando Pacheco, defender of former federal deputy José Genoino, who clashed with the president of the Supreme Federal Court, Minister Joaquim Barbosa, during a session on June 11. The request to open the investigation was made by the Public Prosecutor's Office in the Federal District, following a complaint filed by Barbosa.

During the session on the 11th, the lawyer insistently requested that the court analyze Genoino's request for house arrest and had his microphone turned off by Barbosa, who was presiding over the session. Upon persisting, the lawyer was eventually removed from the plenary session by order of the president of the Supreme Federal Court. Once outside the session, he said that Barbosa is a "nefarious" figure and compared him to Torquemada, the fervent Spanish inquisitor of the 15th century. 

In the complaint he sent to the Public Prosecutor's Office, Barbosa mentions contempt, slander, defamation, and libel. The request to open an investigation was sent on the 17th by prosecutor Anna Paula Coutinho de Barcelos Moreira. The Federal Police say they have already opened the investigation, which has a 30-day deadline, renewable.

In the document sent, the Public Prosecutor's Office requests that the Federal Police take statements from the lawyer and the security guards who removed him from the plenary session, as well as obtain the images from the session. After the investigation, it will be up to the prosecutor to decide whether or not to file criminal charges against Pacheco. There is no date set for this decision.
