Viana requests investigation into arrests related to AP 470.

A senator from the Workers' Party (PT) has submitted a request for the Minister of Justice, José Eduardo Cardozo, and the Attorney General of the Republic, Rodrigo Janot, to investigate whether there was any illegality in the arrests made on Friday the 15th; "Why didn't Minister Joaquim Barbosa present the necessary documents for the arrests? Why were they carried out on a holiday? To humiliate?"; the parliamentarian also requested Barbosa's swift action on the request for house arrest for José Genoino.

247 - Senator Jorge Viana (PT-AC) presented, on the afternoon of Thursday the 21st, a request for the Minister of Justice, José Eduardo Cardozo, and the Attorney General of the Republic, Rodrigo Janot, to investigate any possible illegality in the act of arresting those convicted in Criminal Action 470 by the President of the Supreme Federal Court (STF), Joaquim Barbosa, last Friday the 15th.

Viana stated that Barbosa should have submitted two documents, which he considered "basic," along with the arrest warrants: the commitment order and the sentencing document, which he failed to do. "When, in this case, the Supreme Court Justice is the judge who orders the arrest, it is his responsibility to present the commitment order and the sentencing document. And why didn't he? Why were the arrests made on November 15th, a holiday? To humiliate? If it was to humiliate, then he is already acting outside the Constitution," he declared in plenary.

The congressman also requested that Joaquim Barbosa expedite the case of Congressman José Genoino, who is imprisoned in the Papuda penitentiary and suffers from a serious heart condition. The Workers' Party member fell ill this morning and was transferred to the Heart Institute in Brasília for tests. The Supreme Court Justice is evaluating a request from Genoino's lawyers for him to serve house arrest due to health reasons.

"When we left there today, he already had high blood pressure," Viana said, regarding the visit that the senators and deputies made to Genoino, José Dirceu, and Delúbio Soares today at Papuda prison. "Even more serious than Genoino's situation is the lack of a decision from the Judiciary. We are not questioning the Supreme Court's sentence. It must be carried out, but we are questioning how it will be carried out," he protested, recalling that his colleague may be at risk of death in prison.
