PT's request could lead to Barbosa's impeachment.
PT leader Wellington Dias (PT-PI) argued that the Senate, presided over by Renan Calheiros (PMDB), should use its constitutional power to file a complaint against the president of the Supreme Federal Court for violating the Constitution in the arrests of the defendants in AP 470; however, the PT member did not receive approval from President Dilma Rousseff for fear of a clash between the branches of government; "I cannot make any public statement about the arrests so as not to create an institutional crisis," Dilma told the senators.
247 - In a meeting with leaders of the allied base in the Senate, including President Dilma Rousseff, the leader of the PT (Workers' Party), Wellington Dias (PT-PI), argued that the Senate should use its constitutional power to file a complaint against the president of the STF (Supreme Federal Court), Joaquim Barbosa.
Members of the Workers' Party (PT) believe that Barbosa violated the Constitution by ordering the imprisonment of those sentenced to semi-open regimes in closed regimes, by not heeding requests to serve sentences in their place of residence, and by not providing adequate treatment to those who need medical care, such as Congressman José Genoino (PT-SP).
If the process is opened, it could result in Barbosa's impeachment, among other sanctions against the president of the Supreme Federal Court. However, the Workers' Party leader did not have the approval of President Dilma Rousseff or the other leaders present, who feared yet another conflict between the Legislative and Judicial branches.
The president, however, said she was concerned about Genoino's situation. According to her, the doctor Roberto Kalil, who is treating him, gave a dramatic account of his state of health. "Kalil told me that Genoino's problem could be fatal. But I cannot make any public statement about the arrests so as not to create an institutional crisis. This is a very delicate matter," Dilma told the senators, according to a report by the leader of the PP party, Senator Benedito de Lira (PP-AL).
