Moraes defends maximum time limit for preventive measures.
During his Senate confirmation hearing, the nominee for Supreme Court Justice said the measure would "relieve the burden on the criminal justice system"; in another response, Alexandre de Moraes downplayed the case of the hacker who invaded the cell phone of the First Lady, Marcela Temer, and stated that the investigation followed the exact same pattern as such cases – extortion; regarding the accusation of plagiarism in one of his books, he attributed it to the "resentment" of a professor who competed with him for a teaching position at USP and was rejected; watch live
247 - During the hearing at the Senate Constitution and Justice Committee, the licensed Minister of Justice, Alexandre de Moraes, denied on Tuesday (21) having been a lawyer for the criminal faction PCC.
In 2014, during the election campaign, Moraes reported, a state deputy from São Paulo asked his brother, a city councilor in the capital and a member of the Transcooper cooperative, to borrow a garage for a meeting.
At the time, two people under investigation for links to the faction were present in the garage, according to Moraes. "Absolutely nothing was proven in relation to the congressman, to Transcooper, which lent the garage, much less anything in relation to the office. First, [the office] didn't know about the meeting, second, it knew nothing about the garage," emphasized the minister on leave.
Asked about the plagiarism accusation, Moraes attributed the story, published earlier this month by the newspaper "Folha de S.Paulo," to the "resentment" of a professor who competed with him for a teaching position at the University of São Paulo (USP) and was rejected. "The Spanish Constitutional Court said that the cited content is a compilation of public decisions. The author's widow was misled by the reporter, who told her 'it was copied.' And she said: 'If there was copying, it shouldn't have been done.' Something absolutely defamatory," Moraes stated.

The Constitution, Justice and Citizenship Committee (CCJ) will question the licensed Minister of Justice, Alexandre de Moraes, nominated by President Michel Temer for the position of Minister of the Supreme Federal Court (STF), this Tuesday (21). In addition to senators, citizens can participate in the questioning by sending questions and comments through the e-Citizenship Portal.
Watch the session live on TV Senado.
Alexandre de Moraes is the first name chosen for the court by Temer, who assumed the leadership of the Executive branch in May 2016. He was nominated for the vacancy left by Minister Teori Zavascki, who died in a plane crash on January 19.
Questions
During the confirmation hearing, the senators who are members of the CCJ (Committee on Constitution, Justice and Citizenship) can ask Alexandre de Moraes his opinions on topics that fall under the purview of the STF (Supreme Federal Court) or are being discussed in society and the National Congress. They can also question the nominee about his professional background and other facts of his life that they consider relevant.
Each senator will have ten minutes to formulate their questions, and Moraes will have the same amount of time to respond. Rebuttals and rejoinders, of five minutes each, are also planned.
There is no time limit for the confirmation hearing, and its duration can vary greatly. The hearing for Minister Edson Fachin in 2015 lasted more than 11 hours, while the hearing for Teori Zavascki in 2012 was completed in just over three hours.
About Me
Immediately after the hearing, the committee will vote on the nomination in a secret ballot. The name needs to be approved by a simple majority of the members (majority of those present at the meeting). If the result is favorable to the nomination, the CCJ's opinion will be sent to the Senate plenary. The Senate president, Eunício Oliveira, has already expressed his intention to hold the plenary vote on the same day.
Alexandre de Moraes needs the approval of at least 41 of the 81 senators to become the new minister of the Supreme Federal Court. The vote in plenary will also be secret.
