Brasilia – Federal Deputy Sandro Mabel (PMDB-GO) filed a writ of mandamus with the Supreme Federal Court (STF) requesting the annulment of the election of fellow deputy Eduardo Cunha (PMDB-RJ) to the leadership of the PMDB in the National Congress. According to Mabel, the election was irregular because it involved two deputies who were illegally appointed.

The election for PMDB leader took place last Sunday (3), with Cunha winning after voting in two rounds, defeating Mabel and deputy Osmar Terra (PMDB-RS). According to the Goiás parliamentarian, the victory was only possible after a political maneuver that resulted in the inauguration of deputies Marcelo Guimarães Filho (PMDB-BA) and Leomar Quintanilha (PMDB-TO).

The PMDB members took the seats of João Carlos Bacelar (PR-BA) and Lázaro Botelho (PP-TO) last Saturday. "Both incumbent deputies, belonging to other parties, stepped aside to enable the swearing-in of the alternates for the first time in this legislature," argued Mabel.

According to the congressman from Goiás, the inauguration was carried out in a "quick and targeted" manner and did not follow the procedure stipulated in the Constitution, which mandates a new session date if the opening of the legislative year falls on a weekend or holiday. Mabel also criticized the interference of parties outside the PMDB in the party's affairs. The rapporteur for the writ of mandamus, which includes a request for an injunction, is Minister Luiz Fux.
