Brazil Agency - Supreme Court Justice Edson Fachin has just denied an appeal to suspend the decision that ordered the removal of Senator Aécio Neves (PSDB-MG) from legislative activities, determined by the Court's First Panel last week, which also imposed nighttime house arrest on the parliamentarian.

In the writ of mandamus filed yesterday (2), Aécio's lawyer, Alberto Toron, asked that the removal be suspended at least until the direct action of unconstitutionality (ADI) is judged on whether or not the Legislature needs approval for the Judiciary to apply precautionary measures against parliamentarians. The ADI is scheduled to be judged on October 11.

In the proceedings, Toron argues that Aécio "cannot, for criminal procedural purposes, be treated like any other public official," among other arguments. "This is because the Federal Constitution sets him apart, granting him special prerogatives. If he cannot be arrested, one must ask: can the measure, which is an alternative to imprisonment, be imposed on him?" he inquired.
