Delta presented false documents to the government of Brasília.
The Federal District government will open administrative proceedings against Fernando Cavendish's company; a decision by the Regional Federal Court considers the certificate of technical capacity given during the 2009 bidding process for urban cleaning services to be false.
Andressa Anholete _Brasília 247 – The saga of the bidding process for the urban cleaning service (SLU) in the Federal District (DF) has taken a new turn. On April 12th, the Federal Regional Court of the First Region, located in Brasília, deemed the certificate of technical capacity presented by Delta to be false. As a result, the company is expected to cease garbage collection in two areas of the capital in the coming days.
This certificate is the same one that, in 2009, led the bidding committee to prevent the company from assuming the service provision. This position changed with the court decision of the Federal District and Territories Court of Justice in December 2009, which declared Delta the winner of the consortium.
Since the certificate was from the Regional Council of Engineering, Architecture and Agronomy of Tocantins (Crea-TO), the companies affected by the change, Qualix and Valor Ambiental, filed a lawsuit in the state's Federal Court to reverse the situation. The decision in this case came out this week, but an appeal is still possible.
The Secretary of Transparency and Management, Carlos Higino, explained that in the coming days the government will open an administrative process in which Delsta should be declared ineligible. Regarding its departure from SLU, the secretary explained that the process is already underway. “SLU is already analyzing the case to ensure this transition is done smoothly. Garbage collection is an essential service; it cannot be interrupted for even a day. The situation is not easy,” stated Higino.
