The meeting took place at a time when the current Minister of Justice, Alexandre de Moraes, is being pressured due to the crisis in the prison system that has already left more than 111 dead in just the first 15 days of the year. Ayres Britto was considered for the position before Temer opted to put Moraes in the post, within the quota of the PSDB of São Paulo.

Despite the pressure on the head of the Justice Ministry, Temer's advisors say that the meeting between him and the former minister was not only to discuss the crisis in the prison system, but also for the former Supreme Court Justice to help overcome the differences between the government and the president of the Court, Justice Cármen Lúcia.

The prominence and positions adopted by the minister, especially in the prison system crisis and the renegotiation of state debts, have generated increasing distrust among members of the Temer government's leadership towards the Judiciary.

One of the latest points of friction between the government and the president of the Supreme Federal Court occurred when Cármen Lúcia granted preliminary injunctions that allowed the release of R$ 337 million deposited in accounts belonging to the government of Rio de Janeiro, funds that the federal government was claiming to use to settle debts.

The decision deeply angered Finance Minister Henrique Meirelles, who saw the action as a risk to the fiscal adjustment policy.
