BRASILIA (Reuters) - Kim Kataguiri, a candidate for federal deputy for the DEM party in São Paulo and one of the coordinators of the Free Brazil Movement, asked the Superior Electoral Court (TSE) this Wednesday to immediately block the registration of former president Luiz Inácio Lula da Silva's candidacy for the Planalto Palace based on the Clean Record Law.
The request was submitted 25 minutes after the coalition led by the PT registered Lula in the presidential race. Minister Admar Gonzaga was appointed as the rapporteur for the case.
In the lawsuit, Kim Kataguiri argues that there is no doubt that the former president is ineligible since the publication of the ruling by the Federal Regional Court of the 4th Region (TRF-4) regarding the conviction of the Workers' Party member in the Guarujá triplex case.
The MBL coordinator cites the fact that Lula was convicted by a second-instance collegiate body, one of the reasons for falling under the Clean Record Law.
The candidate for federal deputy argues that Lula's registration should be blocked ex officio in cases of "evident ineligibility," meaning by the rapporteur of the request without needing to hear from the parties involved. The action cites a TSE (Superior Electoral Court) ruling that supports this understanding.
"Given the candidate's ineligibility – as in the case of the Respondent – it is blatantly immoral to grant the applicant television and radio time, as well as to allocate resources from party and electoral funds to him for campaigning," the lawsuit states.
Actor Alexandre Frota, a candidate for federal deputy for the PSL party, was another who questioned the former president's candidacy.
The Workers' Party (PT) submitted Lula's candidacy registration to the Superior Electoral Court (TSE) at 17:12 PM, a request that was personally overseen by prominent party figures such as former president Dilma Rousseff, Lula's running mate Fernando Haddad, and the president of the PT, Senator Gleisi Hoffmann.
According to the Federal District Military Police, the registration of the candidacy was attended by approximately 10 supporters, who held a large rally near the courthouse. The demonstration was peaceful.
