According to a note by columnist Mônica Bergamo, the agreement stipulates that Supreme Court Justice Dias Toffoli will present a vote stating that Renan Calheiros could not assume the Presidency of the Republic because he is a defendant in a case before the Supreme Court, but that this does not prevent him from remaining in charge of the Senate.
"Celso de Mello, the senior member of the Supreme Court, can say, right at the beginning of today's session, that he has already decided in this sense in the session that discussed whether a politician who is a defendant could remain in a position that is in the line of succession to the Presidency of the Republic, as is the case of the presidency of the Senate. Besides him, ministers Ricardo Lewandowski, Luiz Fux, Teori Zavascki, and even the president of the court, Cármen Lúcia, could follow Dias Toffoli," says columnist Monica Bergamo.
