The news report had first-hand access to the decision, judged by the TRT-2 (Regional Labor Court of the 2nd Region). SBT asked Judge Ronaldo Luis de Oliveira to reconsider the first-instance decision that condemned it to pay R$ 500 for recognized employment relationship and moral damages for discriminatory treatment that Rachel allegedly suffered on several occasions.
SBT also requested a review and clarification regarding the payment of seniority bonuses and attorney's fees. However, the judge did not agree with any of the requests made by Silvio Santos's TV network's defense. According to him, the initial decision is straightforward and makes it clear that there was a breach of labor rights and harassment against Rachel, who hosted the SBT Brasil news program between 2011 and 2020.
Because of SBT's insistence on issues that have already been clarified, the judge ended up reprimanding the company's legal team. He stated that the TRT-2 (Regional Labor Court of the 2nd Region) will no longer accept appeals from the broadcaster claiming that Rachel had a recognized employment relationship with SBT, because the court has already reiterated points that have been raised several times in the legal battle.
"In this regard, it is expected that the appellant will cease reiterating the arguments highlighted above, which have already been duly clarified in the judgment, especially since, in this act, she is warned, pursuant to articles 793-A to 793-C of the CLT. Insistence will not be tolerated," the judge stated in the decision.
