247 - "Technical" and "important": that's how journalist Joaquim de Carvalho summarized it. decision do Supreme Federal Court (STF) Justice Ricardo Lewandowski to keep the case in court. accusations by lawyer Tacla Duran against the biased former judge and senator Sergio Moro (União Brasil-PR) and the former Lava Jato prosecutor and federal deputy Deltan Dallagnol (Podemos-PR).
Duran accuses the pair of extortion during the Lava Jato operation. He claims they demanded bribes from the lawyer in exchange for his freedom. In testimony to federal judge Eduardo Appio of the 13th Federal Court of Curitiba on March 27th, Duran stated that he deposited US$613 to a lawyer linked to Rosangela Moro, wife of Sergio Moro, in 2016. The purpose of the payment was to secure a plea bargain from Tacla Duran, a fact allegedly known to then-prosecutor Deltan Dallagnol. Upon discontinuing the payments, Duran was allegedly targeted for arrest by Moro.
By requesting that the case be removed from the Supreme Federal Court (STF) and not returned to the 13th Federal Court of Curitiba, Moro "wants to choose the judge" who will try him – Moro's defense argues that Appio is biased in judging him. "Moro wants to remove the case from the STF and wants to remove Judge [Eduardo] Appio. Moro wants to choose the judge because he knows what he did, he knows it could be complicated. He knows that if there is a real investigation, he will go to jail. So he wanted to choose a forum," said Carvalho on TV 247.
Lewandowski, however, listening opinion of the Attorney General's Office (PGR)The court decided to keep the case in the Supreme Federal Court (STF), understanding that Moro continued to commit the 'alleged' crime against Duran while serving as Minister of Justice under Jair Bolsonaro (PL). "Based on the Attorney General's statement, the prosecutor is saying: 'look, it stays in the Supreme Court'. And why? Moro says 'it's not the Supreme Court because I wasn't a senator [at the time of the case]'. If he were a judge, it would be in the TRF-4. But the alleged crimes – and that's what Lewandowski says – attributed to Sergio Moro continued over time. That's what's important about his decision. Moro, as Minister of Justice, acted to harm Tacla Duran, because the Ministry of Justice withheld documents, did not inform Tacla Duran's defense about procedures that had been taken, thus harming the defense. Therefore, he continued to use his power to persecute Tacla Duran. What does Lewandowski say, technically? Since there is evidence that he committed the alleged crimes in the Ministry of Justice, when he was minister, and later as a senator, the case stays here [in the Supreme Court]. And Deltan Dallagnol stays due to connection."
