Lula goes to the Supreme Court for right of reply on Jornal Nacional (JN).
Former President Lula filed a complaint with the Supreme Federal Court against TV Globo, specifically against a report on Jornal Nacional broadcast on March 10th. The report addressed the accusation made by three prosecutors from the São Paulo Public Prosecutor's Office that he had concealed assets in the case of the triplex apartment in Guarujá (SP) and reported on the request for his preventive detention. According to Lula's defense, the report "did not even give the complainant the opportunity to present his version of the facts." Lula is requesting the Supreme Court to grant an injunction ordering TV Globo to broadcast his response on Jornal Nacional. The complaint will be reviewed by Justice Edson Fachin.
247 - Former President Lula has filed a complaint with the Supreme Federal Court against TV Globo, specifically against a report on Jornal Nacional. Lula's defense claims he was denied the right to reply to a report broadcast on March 10th. The complaint will be reviewed by Justice Edson Fachin.
The article dealt with a complaint filed by three prosecutors from the Public Ministry of São Paulo against Lula, his wife Marisa Letícia, and 14 other people. The report detailed the prosecution's accusation that Lula concealed assets in the case of the triplex apartment in Guarujá (São Paulo state) and informed about the request for the former president's preventive detention made by the three prosecutors.
According to Lula's defense, the report "did not even give the plaintiff the opportunity to present his version of the facts." Lula is asking the Supreme Court to grant an injunction ordering TV Globo to broadcast his response on the Jornal Nacional news program.
Lula's lawyers cite the Supreme Court's decision in ADPF 130, which in 2009 declared the Press Law unconstitutional and, consequently, eliminated the infra-constitutional regulation of the right of reply. "The right of reply not only guarantees personality rights, but also ensures everyone the right to accurate and precise information," they stated.
