In light of the events of recent years, the Union of Workers in Radio and Television Broadcasting Companies in the State of São Paulo sent a letter to President Dilma Rousseff requesting the revocation of the station's license. In response, the Presidency of the Republic stated that, due to the nature of the matter, the document was forwarded to the Ministry of Communications.
The president's return occurred this week, six days after the union sent the request. Comunique-se had access to the documents regarding the case. Filed in Brasília, the letter mentions the "disastrous administration of the former owner (TV Manchete Ltda) and the 'even worse' stance of the current owner of the Channel 09 [São Paulo] concession, TV Ômega Ltda, which operates under the name Rede TV".
According to the organization, the situation at the media outlet is chaotic. The document highlighted four points to justify the request:
1- Although the company deducts INSS (Brazilian Social Security) contributions monthly from employees' salaries, which constitutes the crime of misappropriation, it does not transfer these amounts to the Social Security coffers. Obviously, the company also does not pay its share of social security contributions to the Social Security system.
2- The company fails to make the required contributions to the Severance Indemnity Fund (FGTS) for its employees;
3- Dismissed workers do not receive their severance pay, do not have their FGTS (Brazilian employee severance fund) and the 40% penalty deposited, and are not even provided with the forms to apply for unemployment insurance.
4- Although it deducts union dues from workers' salaries, it does not transfer them to the union, the federation, the central union organization, or the Ministry of Labor, simply appropriating these amounts for itself.
According to information from the Presidency of the Republic, the case was forwarded to the Ministry through Official Letter number 1965/2013-GP/GAB/GESTÃOIDGI. To follow the progress of the process, it is necessary to contact the indicated body directly.
Regarding the matter, Rede TV issued a statement: "RedeTV! is completely up-to-date with its labor obligations. What happened is that the network has already won a ten-year battle in which it was ultimately ruled that it was not the successor to TV Manchete's debts."
