A bill proposed by Representative Jutahy Magalhães Jr. (PSDB) alters the deadline for replacing a majoritarian candidate who resigns from the electoral process. According to the representative, currently this practice occurs at any time during a campaign for those who are prevented from running for election due to resignation or death; "What has been happening in each election is that the nominated majoritarian candidate resigns on the eve of the election, and the TSE (Superior Electoral Court) does not have enough time to adapt the voting system. In the case of proportional elections, the replacement can be made up to 60 days before the election," justifies the representative.

Brazilian congressman Jutahy Magalhães Jr., from the PSDB party, presented a bill (PL) that alters the deadline for replacing a major candidate who resigns from the election. According to the congressman, currently the practice occurs at any time during a campaign for those who are prevented from running for election due to resignation or death.
"What has been happening in every election is that the designated leading candidate resigns on the eve of the election, and the TSE (Superior Electoral Court) does not have enough time to adapt the voting machine. In the case of proportional elections, the substitution can be made up to 60 days before the election."
According to Jutahy's proposal, political parties and coalitions will be prevented from replacing candidates for major offices, thus avoiding, according to the congressman, violations of the law and the rights of voters.
"It consists of defining a maximum period of 15 days for the resignation to allow for the replacement of the candidate, thereby avoiding fraud and disruptions that contribute to jeopardizing the election and increasing the voter's lack of confidence in the transparency and efficiency of the Justice system."
Jutahy is a full member of the Constitution, Justice and Citizenship Committee of the Federal Chamber.
