The Military Court of Justice of São Paulo wants to authorize the police to alter crime scenes.

The resolution has been suspended since Monday (28) by the Court of Justice of São Paulo and awaits judgment to be shelved; the Ombudsman of the Military Police of São Paulo itself criticizes the measure and believes that the procedure could be used to cover up crimes committed by police officers.

Brazil Current Network - A ruling by the Military Court of Justice of São Paulo allows military police officers to collect objects from the scene of crimes committed by soldiers against civilians. According to the police ombudsman's office, the measure will be used to cover up crimes committed by military police officers. The text is currently suspended by an injunction from the Court of Justice (TJ-SP), but a final ruling is still pending to determine whether it will come into effect or be shelved.

A prime example of police officers altering a crime scene is... of the cart driver Ricardo Teixeira Santos, nicknamed Negão, 39 years oldHe was killed in July of this year in Pinheiros, a western district of São Paulo, by two shots fired by a military police officer. The military police collected the bullet casings and the cart driver's body before the forensic team arrived.

"They defied the Federal Constitution, in front of almost a hundred people, altering the crime scene. They removed the evidence to disguise it and avoid penalizing the perpetrator," stated the ombudsman of the São Paulo Military Police, Júlio César Fernandes Neves, in an interview with reporter Michelle Gomes. TVT.

The resolution, suspended this Monday (28), is considered unconstitutional. "The court, through a preliminary injunction, provisionally anticipated the understanding that this measure is unconstitutional. There will be a trial that may confirm or not the measure granted. In my view, this decision was correct, even if it was a preliminary injunction," says Martin de Almeida Sampaio, director of the Human Rights Commission of the OAB-SP.

According to experts, the alteration of crime scenes by some police officers is a common practice. old and recurring"It's not recent, it's old. There's a crime that occurred in São Paulo in the 1970s, in which 13 young people from Jardins were murdered and, admittedly, the crime scene was tampered with. Since then, it has become routine. This is a carte blanche for those who want to act freely, committing homicides," says ombudsman Júlio Cesar.
