TRF4 sets new record by judging Lula's appeals after analysis by the Public Prosecutor's Office: 3 days

247 - In yet another demonstration that it accelerates the analysis time when dealing with cases involving former President Lula, the Federal Regional Court of the 4th Region (TRF-4) acted more quickly in judging the extraordinary appeals presented by the defense after they were analyzed by the Federal Public Prosecutor's Office: in just three days, from June 19 to 22.
In a comparison with five other Lava Jato trials, the time interval between the Public Prosecutor's Office's response to extraordinary appeals, known as "counter-arguments," and the admissibility review by the Porto Alegre Court varied between seven and 132 days. In the latest case concerning the former president, the extraordinary appeals were filed with the TRF4 (Regional Federal Court of the 4th Region) on April 23rd. As of this Friday, the court had not yet issued a ruling. The delay in the review was criticized by the defense, which pointed out that the same court took 42 days to review the sentence imposed by Sérgio Moro, which was 238 pages long.
In the decision, in January, the case's rapporteur, Judge João Pedro Gebran Neto, presented a 430-page report in which he increased Lula's sentence to 12 years and one month in prison. The trial was scheduled for the first available date in January, just 196 days after the publication of Moro's sentence. less than half the average time for judgments between one instance and another.
This time, the task of deciding on the admissibility of the appeals, whether or not to send them to higher courts, fell to the vice-presidency of the TRF4 (Regional Federal Court of the 4th Region). The fact that the trial had not yet taken place was the reason why the defense filed an appeal with the Supreme Court arguing that, if the final appeals in the trial had not yet been analyzed, Lula could not be imprisoned.
