Constitutional Court approves intervention in two municipalities of AL
In a session, the Councilors of the Court of Auditors of Alagoas approved a request for intervention in the municipalities of Passo de Camaragibe and Japaratinga, both located on the northern coast of the state. The reason was the failure to present the financial statements for the last few years. The State Government will be informed of the decision, which, in turn, will forward the communication to the Legislative Assembly so that it can appoint the intervener. Once the name is chosen, the parliament will send it to the Executive branch for a decision on whether or not to accept the nomination.
Alagoas247 - The municipalities of Japaratinga and Passo de Camaragibe may be subject to state intervention. The full bench of the Court of Auditors of the State of Alagoas (TCE/AL) approved the procedure, and the mayors of these municipalities are expected to be temporarily removed from office.
Besides Japaratinga and Passo de Camaragibe, other municipalities also failed to submit their financial statements for recent years to the (TCE/AL). As a result, other municipalities may also face state intervention, with Governor Teotonio Vilela Filho (PSDB) tasked with appointing the official who will manage the administration and obtaining the documents requested by the TCE/AL advisors. The deadline was April 30th; a new period was granted, but the mayors ignored the request.
According to the Court, a new date cannot be granted, and therefore, the only legal solution found is to request intervention. Thus, during this period, the mayors should, in theory, be removed from the administration of the municipalities. The objective, according to the TCE/AL (Court of Accounts of Alagoas), is to ensure the legitimacy in obtaining the information.
Despite the warning, the Court of Auditors still does not know the number of municipalities that may be subject to intervention. However, it emphasizes that the administrators were aware of the administrative measures that would be taken in case of non-compliance.
According to the president of the Association of Municipalities of Alagoas, Marcelo Beltrão (PTB), the entity has not yet been contacted by mayors or members of the TCE.
