247 The Superior Court of Justice (STJ) decided to uphold the criminal investigation against Robson Marinho, a member of the Court of Auditors of the State of São Paulo (TCE).

Minister João Otávio de Noronha accepted the statement from the Attorney General's Office and denied the request from the council member's defense.

He was removed from office in August 2014 by a decision of the 13th Public Treasury Court of São Paulo, in a civil action for administrative misconduct brought by the State Public Prosecutor's Office.

Marinho is accused of receiving bribes to act in favor of the French company Alstom. The precautionary measure was proposed based on an investigation initiated in 2008, reinforced with documents from Switzerland, recently received by the agency.

According to prosecutor Sílvio Marques, the Swiss courts have already confirmed in two instances that Marinho moved approximately US$2,7 million through offshore accounts. “Regarding a US$50 million contract, bribe payments were made amounting to around 15% to 17% of the total contract value. In 1998, these amounts were allegedly paid and distributed to various public officials,” Marques detailed concerning the contract for the construction of power stations, which in current values totals R$268 million.
