PT manages to reverse the rejection of Luiz Marinho's accounts.
In June of this year, the City Council of São Bernardo do Campo, in the ABC Paulista region, had rejected the 2015 accounts of the city hall, when it was under the administration of Luiz Marinho, a pre-candidate for governor of the state; the decision could have declared the Workers' Party member ineligible; however, a preliminary injunction this Friday, the 10th, reverses the Legislative decision and guarantees his candidacy on August 15th.
SP 247 - The PT (Workers' Party) managed to reverse this Friday, the 10th, a decision by the City Council of São Bernardo do Campo, in the ABC Paulista region, which in June had rejected the 2015 accounts of the city hall, when it was under the administration of Luiz Marinho.
The decision could have declared Marinho, the PT's pre-candidate for governor of São Paulo, ineligible. However, this morning's injunction reverses the Legislative Assembly's decision and guarantees his candidacy until August 15th.
In the decision of the Court of Justice of São Paulo, district of São Bernardo, the judge concluded that "the constitutional principles of due process and the right to a full defense, as evidenced in the records, were not observed by the City Council in the legislative procedure that resulted in the rejection of the accounts."
Marinho argued in his defense that he was "not previously notified of the judgment of the accounts by the City Council and was unable to present his defense, only learning about the judgment through the press."
