Police request pre-trial detention of suspects.
Suspected of involvement in the Kiss nightclub fire, the two owners of the club and the two members of the band Gurizada Fandangueira have been detained for a month in the Santa Maria State Penitentiary; the justification for the request for preventive detention is the need to extend the deadline for concluding the investigation by 10 days.
Sul 21 - The group of delegates investigating the fire at the Kiss nightclub in Santa Maria filed a request this Thursday (28) for the preventive arrest of the two partners of the nightclub and the two members of the band Gurizada Fandangueira, identified as responsible for the deaths of 239 people in the fire that occurred on January 27.
The delegates justified the request by citing the need to preserve the lives of those under investigation, as well as the necessity of extending the deadline for concluding the inquiry by 10 days. The four suspects have been detained for a month at the Santa Maria State Penitentiary.
Also on Thursday, lawyer Jader Marques, who defends Kiss nightclub owner Elissandro Callegaro Spohr – known as Kiko – released a statement to the press, claiming that the Public Prosecutor's Office (MP) of Santa Maria could have requested the closure of the nightclub in 2011. At the time, the owners and the agency signed a Conduct Adjustment Agreement (TAC) that stipulated the resolution of noise pollution problems.
The Public Prosecutor's Office had rejected the request for an extension of Kiko's imprisonment made by his lawyer. According to prosecutors Joel Oliveira Dutra and Maurício Trevisan, "the lawyer has no legitimacy whatsoever to request (or extend) the imprisonment, under any circumstances, of his own client." The decision was sent to Judge Ulysses Fonseca Louzada, of the 1st Criminal Court of Santa Maria, and was denied this Wednesday by the Santa Maria Court.
