Federal Public Prosecutor's Office wants Assembly to suspend subsidies.
The Regional Electoral Prosecutor's Office in Sergipe (PRE/SE) recommended to the president of the Legislative Assembly of Sergipe, Deputy Angélica Guimarães (PSC), that she suspend the transfer of subsidy funds for charitable donations from deputies; according to the recommendation, the transfer of these funds violates electoral legislation, which prohibits the free distribution of goods, values, or benefits by the Public Administration in an election year; the PRE/SE also initiated proceedings to monitor and prevent possible misuse in the distribution of subsidy funds by the Legislative Assembly, after gathering information from the press that, in 2014, the funds for charitable donations were increased from R$ 900 to R$ 1,5 million for each of the deputies.
Sergipe 247 - The Regional Electoral Prosecutor's Office in Sergipe (PRE/SE) recommended to the president of the Legislative Assembly of Sergipe (Alese), Deputy Angélica Guimarães (PSC), that she suspend the transfer of subsidy funds for welfare donations from parliamentarians. According to the recommendation, the transfer of these funds violates electoral law, which prohibits the free distribution of goods, values, or benefits by the Public Administration in an election year.
PRE/SE also initiated proceedings to monitor and prevent possible misuse of subsidy funds by Alese, after gathering information through the press that, in 2014, the funds for charitable donations from the assembly were increased from R$ 900 to R$ 1,5 million.
The recommendation further warns that, according to decisions of the Superior Electoral Court, in cases of donations, "it is not necessary to demonstrate an electoral character or personal promotion of the public agent, the mere practice of the illicit act is sufficient" for the irregularity to exist.
PRE also recommended that, if any donation has already been made using the subsidy funds, the Public Prosecutor's Office should be provided with details of how the funds were used, including the beneficiaries' information, the amounts transferred, and the names of the deputies responsible for indicating the donation.
The Regional Electoral Prosecutor's Office warns that, in case of non-compliance with the recommendation, the fact may be used as evidence in electoral proceedings and will be analyzed in appropriate administrative and judicial measures.
