The Federal Regional Court of the 4th Region (TRF4) today (May 23) denied the appeals for clarification filed by former PT treasurer Delúbio Soares de Castro, operator Enivaldo Quadrado, economist Luiz Carlos Casante, and businessman Natalino Bertin. The 8th Panel partially granted the appeals for clarification filed by businessman Ronan Maria Pinto and reduced the amount of compensation to R$ 6 million. They appealed after their conviction for money laundering in the Lava Jato Operation was upheld by the court in March of this year.
According to the rapporteur, Federal Judge João Pedro Gebran Neto, motions for clarification are only admissible when there is ambiguity, obscurity, contradiction, or omission, which is not the case here. Gebran emphasized that "the mere disagreement of a party with the grounds invoked that led the judging body to decide does not open the way for the use of motions for clarification."
The judge also emphasized that the defense sought a re-evaluation of the conclusions resulting from the assessment of the evidence, which cannot be done through a motion for clarification.
Regarding the reduction in compensation to be paid by Ronan Maria Pinto, the rapporteur agreed that the vote set the amount above the minimum, stipulating an increase of R$ 28, and corrected the judgment on this point.
At the end of the vote, Gebran determined that the sentences should begin to be served, as all appeals at the second level had been exhausted.
