Marcelo wants to expedite the candidacy trial.

The coalition "Experience Makes the Change" has asked the Regional Electoral Court (TRE-TO) to personally deliver to the Superior Electoral Court (TSE) the appeal from the Electoral Public Prosecutor's Office (MPE) requesting the Electoral Court to disqualify Marcelo Miranda's candidacy for governor of Tocantins; according to the coalition "The Change We See," this measure was taken because Marcelo's coalition fears not having enough time to replace him if his candidacy is rejected due to the Clean Slate Law; the defense admits urgency in judging, but to eliminate "legal uncertainty."

Tocantins 247 - The coalition "Experience Makes the Change" asked the Regional Electoral Court (TRE-TO) to personally deliver to the Superior Electoral Court (TSE) the appeal from the Electoral Public Prosecutor's Office (MPE) requesting the Electoral Court to disqualify Marcelo Miranda's candidacy for governor of Tocantins.

According to the coalition "The Change We See," the measure was taken because Marcelo's coalition feared not having enough time to replace him if his candidacy were rejected due to the Clean Slate Law. The request, made by the coalition's lawyers, was granted by the president of the TRE-TO (Regional Electoral Court of Tocantins), Judge Jacqueline Adorno. With the decision, the process was sent to the TSE (Superior Electoral Court) by a representative of the coalition, a measure permitted by electoral law and normally used by the author of the appeal.

Miranda's coalition lawyer, Solano Donato, admitted the intention to have the case judged quickly, but stated that the objective is "to end the legal uncertainty," which the governing coalition is allegedly taking advantage of. "The governor's coalition is basing its campaign on the legal uncertainty [regarding Marcelo]. Since the pre-election period, they have been saying that Marcelo is not a candidate. Our concern is that this ends soon," Donato explained to CT (read here). 

In the decision, Jacqueline notes the coalition's fear of not having enough time to change candidates if the registration is denied by the Superior Electoral Court (TSE). "They add that in case of rejection of the registration request, the deadline for candidate substitution is 20 days before the election, which demonstrates the applicants' interest in having the Ordinary Appeal judged by the TSE as soon as possible."

According to the judge, the coalition argues in its request that although the registrations were approved by the TRE-TO (Regional Electoral Court of Tocantins), "until there is a ruling from the TSE (Superior Electoral Court), a certain legal uncertainty will remain, thanks to the public actions of the appellants."

According to the procedural system of the TRE-TO (Regional Electoral Court of Tocantins), the coalition's request was made on August 28th at 11:00 AM and, on the same day, at 14:58 PM, it was already filed with the TSE (Superior Electoral Court) under number RO No. 20837. Since August 30th, at 15:28 PM, the process has been with the Attorney General's Office for an opinion from Eugenio Jose Guilherme de Aragão, where it is attached to the appeal requesting the disqualification of the vice-governor candidate Marcelo Lelis (RO No. 20922).
