Lucimara takes legal action against property tax increase.

Councilwoman Lucimara Passos (PC do B) filed a lawsuit this Friday (27) to suspend the collection of the Urban Property Tax (IPTU); the initiative was taken jointly with the leadership of the PC do B, through its president Hallison Souza, and lawyers Maurício Soares and Leonardo Zirpoli; they filed a Direct Action of Unconstitutionality; "We found that there is a Complementary Law that establishes criteria for determining the market value of properties for the purpose of calculating the IPTU assessment and that the legislator made a serious mistake by bringing normative provisions that are not found in the State Constitution or the Federal Constitution," she said.

247 - Councilwoman Lucimara Passos (PC do B) filed a lawsuit this Friday (27) to suspend the collection of the Urban Property Tax (IPTU). The initiative was taken jointly with the leadership of the PC do B, through its president Hallison Souza, and lawyers Maurício Soares and Leonardo Zirpoli. They filed a Direct Action of Unconstitutionality (ADIN).

According to the parliamentarian, the process requests the granting of a precautionary measure suspending the effectiveness of the law until the final judgment of the action questioning the reassessment of the property value schedule in Aracaju. “Together with legal counsel, we found that there is a Complementary Law that establishes criteria for determining the market value of properties for the purpose of calculating the IPTU (Property Tax) and that the legislator made a serious mistake by including normative provisions that are not found in the State Constitution or the Federal Constitution of Brazil,” explains Lucimara Passos.

According to her, the action questions the constitutionality of the legal provision. “Therefore, we want to suspend its effectiveness. The readjustment is considered unfair and arbitrary, as it violates constitutional principles. The municipal law approved in the City Council, which I voted against, uses criteria for collection that violate the rights and guarantees of the taxpayer,” she concludes.
