TCU's "blacklist" has 138 names from Tocantins.
The president of the TCU (Federal Court of Accounts), Minister Augusto Nardes, delivered to the president of the TSE (Superior Electoral Court), Minister Dias Toffoli, a list of more than 6,5 managers whose accounts were rejected by the body in the last eight years; from Tocantins, the document includes the names of 138 people; among them are state deputy Raimundo Palito (PEN); the former Secretary of Agriculture of the State and pre-candidate for state deputy Jaime Café (PSDB); the mayor of Colinas, José Santana (PT); the mayor of Tocantinópolis, Fabion Gomes (PR); the document, however, does not automatically make the managers ineligible; it is up to the Electoral Court to analyze and decide each case.
Tocantins 247 - The Superior Electoral Court (TSE) already has in its possession the list containing more than 6.500 politicians, managers, and officials whose accounts were deemed irregular by the Federal Court of Accounts and who may be barred from running in this year's elections. The list was delivered by the president of the TCE, Minister Augusto Nardes, to the president of the TSE, Minister Dias Toffoli.
From Tocantins, the document includes the names of 138 people. Among them are state representative Raimundo Palito (PEN), currently Secretary of Labor and Social Assistance; the former Secretary of Agriculture of the State and pre-candidate for state representative Jaime Café (PSDB); the mayor of Colinas, José Santana (PT); the mayor of Tocantinópolis, Fabion Gomes (PR); the former vice-governor Eduardo Machado, the former mayor of Miracema, Rainel Barbosa, among others.

The list of individuals whose accounts have been deemed irregular is not a declaration of ineligibility. The TCU (Federal Court of Accounts) only forwards the list of individuals whose accounts have been deemed irregular to the Electoral Court so that it, based on criteria defined by law and if it deems it appropriate, may declare the person ineligible.
The list is sent to the Electoral Court in election years by July 5th. It contains the names of non-deceased individuals whose accounts were deemed irregular in the eight years immediately preceding each election, provided that the decision deeming the accounts has not been rendered ineffective by an appeal. This list does not include the names of those responsible whose accounts deemed irregular are subject to an appeal with suspensive effect that has not yet been considered by the court, nor those for whom the rulings deeming the accounts irregular have been overturned by a decision of the TCU itself or by the Judiciary.
In 2014, the first round of elections will be on October 5th. The list will include all those responsible whose accounts have been deemed irregular and who are not eligible for appeal, since October 5th, 2006 (the last 8 years). After being sent to the Electoral Court, the list is updated daily until the last day of the year.
It is possible for a name to be removed from the list compiled by the TCU (Brazilian Federal Court of Accounts) if the person responsible no longer meets the legal criteria, such as the existence of a court injunction or the lapse of more than eight years prior to the election. However, this removal is automatic, meaning it is not possible to request the removal of names from the list.
Paying the debt or fine resulting from a TCU (Brazilian Federal Court of Accounts) ruling does not remove the responsible party from the list. The reason for including a manager on the list is the fact that their accounts have been judged irregular by the TCU in the last eight years, a fact that is not undone by compensating for damages or paying a fine. These only prevent debt collection actions.
The list is extracted from the Registry of Accounts Judged Irregular – Cadirreg – compiled and maintained by the TCU (Brazilian Federal Court of Accounts). This Registry includes data on legal entities and individuals, living or deceased, holding or not holding public office or function, whose accounts have been judged irregular by the TCU at any time. Cadirreg is, therefore, a historical registry, not limited to the eight-year period covered by the list sent to the Electoral Court.
