Court orders release of Mais Médicos program records in Minas Gerais.
According to the Ministry of Health, 31 requests filed in Minas Gerais have already exceeded the deadline for delivery; the ministry also states that this is the second local lawsuit filed by the Attorney General's Office to demand the delivery of the registration, the first being in Rio Grande do Sul.
247 - Even with the efforts of medical councils to hinder the full implementation of the “Mais Médicos” program, the courts have been making decisions favorable to the federal government's project. This Friday (27), the Federal Court in Minas Gerais ordered the state's regional medical council to immediately release the documentation whose delivery deadline has already expired. The decision also provides for a fine of no less than R$ 10 per day of non-compliance. A favorable decision for foreign doctors was also granted against the medical council of São Paulo.
The provisional measure that created the "More Doctors" program stipulates that the entities must process the request within 15 days. Without this document, doctors enrolled in the program who trained abroad cannot practice.
"Constitutional precepts cannot be vague promises to citizens; it is up to Public Administrators to make efforts to implement the provisions of the Magna Carta, including training human resources in the medical field for the Unified Health System," states the decision, signed by Federal Judge João Batista Ribeiro.

The Federal Court has not authorized the Regional Council of Medicine of the State of São Paulo to demand from the federal government, in order to grant registrations for the Mais Médicos program, information beyond what is already stipulated in the Provisional Measure that creates the program.
Last week, Cremesp (the Regional Council of Medicine of the State of São Paulo) stated that it would not release the 55 registrations of doctors trained abroad who will practice in São Paulo until the Ministry of Health resolves pending documentation issues.
In the preliminary decision granted this Tuesday (24), Judge Jamil Rosa Oliveira, of the 14th Federal Court of the Federal District, guaranteed Cremesp the possibility of denying registration, but only if the documentation presented is in disagreement with the provisional measure of Mais Médicos.
In other words, the judge did not guarantee the council the right to demand the additional information, but stated that the council retains its power to verify whether the documentation presented is in accordance with the program.
