Trial of congressman accused of homicide is postponed.
For the second time, the trial in the criminal case against state deputy João Beltrão – father of Marx Beltrão, Minister of Tourism – has been postponed. He is accused of ordering the assassination of Corporal José Gonçalves da Silva Filho, which occurred in May 1996. The reason for the new postponement was the lack of a quorum of judges in the plenary of the Court of Justice of Alagoas (TJ/AL).
Alagoas 247 - For the second time, the trial of the criminal action against state deputy João Beltrão, accused of being the mastermind behind the murder of Corporal José Gonçalves da Silva Filho, which occurred in May 1996, has been postponed. The trial was scheduled to take place this Tuesday (26), in the plenary of the Court of Justice of Alagoas (TJ/AL). The reason for the new postponement was the lack of a quorum of judges.
According to information from the press office of the State Public Prosecutor's Office (MPE), eight judges eligible to vote should have been present at the hearing, meaning those without grounds for disqualification or recusal. However, only seven were present, which prevented the process from proceeding, even though it had already been scheduled. The rapporteur is Judge João Luiz de Azevedo Lessa.
"The trial is not expected to take place in the next two weeks because the defendant's lawyer, José Fragoso, will not be able to attend. The new date is projected for October 17th," said the press office.
The Court of Justice's statement confirmed the postponement, while also stating that the possibility of summoning judges for the trial had not been raised, since "there are enough judges who are not disqualified or biased to handle the case."
IN AUGUST
At the end of last month, at the request of the defense, Judge João Luiz Azevedo Lessa had postponed the trial of the criminal case from September 12th to today. Attorney José Fragoso Cavalcanti proved that he would be unable to attend between September 4th and 22nd due to a pre-scheduled trip.
THE CASE
State Representative João Beltrão was accused by the State Public Prosecutor's Office of being the mastermind behind the aggravated homicide that claimed the life of Corporal José Gonçalves Silva, which occurred on May 9, 1996, at the Veloz gas station, located on the banks of Avenida Menino Marcelo, in the upper part of Maceió.
According to investigations, Gonçalves was involved in contract killings, having escaped three other assassination attempts before being killed. According to the indictment from the State Public Prosecutor's Office, the soldier was killed because he refused to kill an enemy of João Beltrão – for whom he was serving at the time.
