Government vetoes bill that would have established a Social Driver's License.

The reasons are varied, including the financial impact on state accounts and expenses for the State Department of Transportation (Detran). 

The order is published in the State Official Gazette (DOE) this Wednesday (18). 

According to the publication, the subject matter concerns the Social Driver's License, a social program for the training, qualification, and professional licensing of motor vehicle drivers. 

The proposal under review provides for exemption from public fees related to services provided by Detran (the Brazilian Department of Motor Vehicles), concerning obtaining, adding to, and changing categories of driver's licenses, as well as acquiring authorization to drive mopeds (ACC). 

In its decision, the government acknowledges the social objectives of the project; however, the matter would violate the State Constitution, considering that "laws concerning tax matters, administrative organization, public services, and the attribution of powers to direct and autonomous administrative bodies are the exclusive prerogative of the Governor of the State."

Furthermore, the proposal has a financial impact on the State's accounts, imposes obligations and expenses on the Department of Transportation, and establishes programs and projects not included in the Annual Budget Law (LOA), nor foreseen in the Budget Guidelines Law (LDO) and the Multi-Year Plan (PPA), which contradicts the rules governing public finances, as provided for in the Constitution. 

"Due to the formal and material unconstitutionality of articles 1, 5, and 8, the other provisions are also affected, as they are interdependent with those tainted by the unconstitutionality, justifying the complete veto of the legislative proposal in question," says an excerpt from the publication. 

Despite the Executive's veto, the bill now goes to the Legislative Assembly (ALE), where it will be considered in plenary session by the deputies, who can either uphold or overturn the veto.

There was an expectation that the government would officially implement the National Social Housing Card by the end of last year. The project seeks to guarantee low-income individuals the right to obtain a driver's license, free of charge – with full subsidies from the Department of Motor Vehicles (Detran) itself – at any driver training center.
