Government goes to court against Sintese strike.
The State Government filed a lawsuit in the Court of Justice of Sergipe requesting the end of the strike by teachers in the state network, which began on Monday (18); the Government requests the illegality of the strike; in a hearing on Tuesday (19), the vice-governor Belivaldo Chagas and the State Secretaries of Education and Finance received the leaders of the Union of Education Workers of the State of Sergipe (Sintese); on that occasion, Belivaldo appealed to the teachers to suspend the strike and return to the classrooms, but the category decided to remain on strike.
Sergipe 247 with ASN - The State Government filed a lawsuit in the Court of Justice of Sergipe requesting the end of the strike by teachers in the state network, which began on Monday (18). The Government requests that the strike be declared illegal. In a hearing last Tuesday, 19, at the Palácio de Despachos, the vice-governor Belivaldo Chagas and the State Secretaries of Education and Finance received the leaders of the Union of Education Workers of the State of Sergipe (Sintese). On that occasion, Belivaldo appealed to the teachers to suspend the strike and return to the classrooms.
Even with the appeal and the government's guarantee that negotiations would continue, Sintese decided to maintain the strike in an assembly held on Wednesday, the 20th. The Union's main demand is the payment of a 13,5% readjustment for all teachers. The State Government has already readjusted the salaries of those teachers whose basic salary was the minimum wage for teachers, which is R$ 1,917.18. Currently, 70% of the category already receive remuneration between R$ 3,000 and R$ 6,000.
According to Complementary Law number 250, of July 2014, which provides for the policy of valuing the Public Teaching Career of the State of Sergipe, the readjustment of the minimum wage for all (active and retired) is linked to the Fiscal Responsibility Law, that is, the readjustments can be granted as soon as the state finances are no longer within the prudential limit established by the LRF.
According to Article 6 of the Regulation, "the Supplementary Law enters into force on January 1, 2015, producing its effects for the commencement of the acquisition of rights and payment of benefits provided therein, from the first day of the four-month period following that in which the personnel expenses of the State Executive Branch, calculated in accordance with Article 18 et seq. of Federal Supplementary Law No. 101, of May 04, 2000, return to a level below 46,55% of the Net Current Revenue of the State of Sergipe".
Based on the law, Sintese's main demand has no legal basis, given that the salary adjustment is guaranteed and linked to the Fiscal Responsibility Law. The current rate is 48%.
